Terms of Use

The conditions for using this corporate website, its publications and enquiry channels, including permitted use, intellectual property and separate platform terms.

Last updated:

1. About these terms

These terms govern access to and use of the corporate website operated by Whalestein Group ("we", "us" or "our"). By using the website, you agree to these terms. If you do not agree, please discontinue use.

These terms concern this website and its content. A separate written agreement, account terms or platform terms will govern any specific investment, service or other relationship. Browsing the website or submitting an enquiry does not create such a relationship.

References to “you” concern the person accessing the website. If you contact us for an organisation or submit information for another person, you are responsible for having the authority needed for that communication. Use of this website does not give you authority to bind Whalestein Group or to make statements on our behalf.

2. Information and service availability

The website introduces Whalestein Group and publishes corporate updates, research and market commentary. Its content is general information, not personalised financial, investment, legal or tax advice, and is not an offer or solicitation to enter an investment or transaction. Read the Disclaimer for the scope and risks of investment-related material.

Business descriptions explain areas of activity or development. They do not by themselves confirm that a particular service is available, suitable for you, authorised in your jurisdiction or agreed to be provided. An item marked “Coming soon”, a disabled destination or an unavailable platform is not an invitation to rely on future access.

Access to information is also distinct from eligibility for a product or service. Requirements may depend on the relevant provider, documentation, jurisdiction and circumstances. Any acceptance of an investment or engagement must be established through the appropriate separate process; the corporate website does not replace that process.

3. Acceptable use

You may browse the website and use its ordinary functions for lawful purposes. You must not:

  • Attempt unauthorised access to accounts, non-public records or website infrastructure.
  • Introduce malicious code, interfere with security controls or disrupt availability through excessive or abusive requests.
  • Submit unlawful material, impersonate another person or provide information you have no right to disclose.
  • Harvest personal information or use the website to misrepresent an association with Whalestein Group.

We may restrict access where reasonably necessary for security, maintenance, lawful compliance or the prevention of misuse. This does not affect rights that applicable law protects.

Do not attempt to bypass a disabled action, an access restriction or a submission limit, or use automated requests in a way that disrupts the site. Do not falsely imply that an enquiry has been accepted, that a commercial relationship exists, or that Whalestein Group has approved your activities. Ordinary access by readers and legitimate search indexing remain subject to applicable law and the website’s technical access controls.

4. Intellectual property

Website text, research, design, software, logos and other materials belong to Whalestein Group or their respective owners and licensors. References to another organisation or its marks do not imply endorsement or a commercial relationship.

You may view the site, follow its links and retain copies for ordinary personal or internal reference. Where applicable law permits quotation, fair dealing or another use, those rights remain available. Otherwise, obtain permission before commercially reproducing, republishing or adapting website materials. Keep relevant attribution and proprietary notices; do not present our material as your own or use our identity to suggest approval.

You may share a direct link to a public page provided that the surrounding presentation is fair and does not imply sponsorship or endorsement. Permission to link does not grant a licence to use our logos as your own branding, frame our pages as part of your service, or reproduce a report for commercial distribution.

For permission to use material beyond the rights granted here or by applicable law, contact admin@whalestein.com with the relevant page, the material requested, the intended audience and the proposed use. Unless permission is agreed, a request alone does not grant it. Third-party materials may require permission from their own rights holders.

5. Enquiries and submitted information

Provide accurate contact details and information relevant to your request. Submitting an enquiry does not guarantee a response time, an appointment, employment, an introduction or acceptance of any proposal.

Personal information is handled under the Privacy Policy. You permit us to review the material you send and use it as reasonably needed to assess and respond to that request. You remain responsible for having the necessary rights and permissions to provide it.

The general enquiry form is not a payment channel, an investor instruction channel or a secure document portal. Do not send account credentials, payment details, identity documents or confidential material requiring a separate agreement through it. Agree suitable arrangements with us before sharing restricted information.

Ordinary correspondence will be considered in the context in which it is sent. An unsolicited proposal does not require us to proceed, negotiate, pay a fee or enter a confidentiality arrangement. If your proposal depends on confidentiality or particular restrictions on use, agree those arrangements before supplying the restricted material. This does not remove the protections applicable to personal information under our Privacy Policy.

A submission receipt confirms that the website has accepted a message for handling. It does not confirm that a transaction has been executed, a payment received or an instruction accepted. Use the relevant service’s authorised channels for account instructions and time-sensitive matters, and do not assume that the corporate enquiry inbox is monitored as a trading or emergency channel.

6. Links and separate platforms

Links may take you to dedicated Whalestein Group platforms or to websites operated by others. Their access conditions, availability, security and data practices may differ. Use the terms and privacy information supplied by the relevant service.

A link is provided for context or access and is not a guarantee of external content or a recommendation to purchase a product. We are not responsible for changes made by an independent website operator.

When you leave this site, review the destination address and the terms relevant to what you intend to do there. Do not assume that these website terms govern a separate account or that your corporate enquiry details have been passed to the destination. A disabled link indicates that access is not being offered through that action; it is not a promise of a launch date.

7. Availability and content changes

We aim to maintain a useful website, but do not promise uninterrupted access, error-free operation or that every item will remain available. We may correct, update, replace or remove content and temporarily suspend functions for operational or security reasons.

Research and announcements may remain online as dated records. A historical publication is not automatically updated whenever circumstances change. Check its publication date and context before using it.

You are responsible for using an appropriate device, browser and connection and for securing any account used to access a restricted publication. We do not guarantee that the website will operate identically on every device or that a temporary copy, cached page or saved image reflects the latest edition.

If access is suspended or a page is removed, rights and responsibilities that have already arisen are not automatically cancelled. Restrictions should be understood in the context of the affected website function; they do not themselves terminate a separate agreement with another Whalestein Group service.

8. Responsibility and liability

You are responsible for deciding how to use website information and for obtaining advice appropriate to your circumstances. The website is provided without a guarantee that its content will satisfy a particular purpose.

To the extent permitted by applicable law, Whalestein Group is not liable for indirect or consequential loss arising from use of, or inability to use, the website, including lost profits or business opportunities. Nothing in these terms excludes liability for fraud, removes a mandatory statutory right or limits any responsibility that cannot lawfully be excluded or limited.

Assess any information in its full context, including its date, assumptions and the limitations of the relevant source. If you believe a page contains a material error, identify it to us rather than treating the presentation as independent verification. A general website statement cannot amend a separately agreed duty or override a protection that the law requires.

9. Applicable law

These terms are governed by the laws of Malaysia, subject to any mandatory law that applies to you. Disputes concerning these terms may be brought before the courts of Malaysia, without limiting any rights or forum protections that applicable mandatory law gives you.

If a provision is held invalid or unenforceable, the remaining provisions continue to apply to the extent that they can lawfully operate independently. A delay in exercising a right does not by itself mean that the right has been waived. These terms should be read with the linked Privacy Policy, Cookie Policy and Disclaimer according to the subject each document addresses.

10. Updates and contact

We may revise these terms to reflect website changes or relevant requirements. The date above identifies the latest edition. Updated terms apply to website use after publication; they do not replace a separate existing agreement.

For questions about website use or permission to reuse material, contact Whalestein Group at admin@whalestein.com.

Review the published version when returning to use the website, particularly if your intended use has changed. Revised terms do not retrospectively remove rights that have already accrued or alter an existing separate contract without the process applicable to that contract. When requesting clarification, identify the page or provision and the use you are considering so that we can understand the question.
